The arbitration shall be administered by JAMS or, where applicable, the American Arbitration Association (AAA) pursuant to the applicable rules and procedures of the administering organization.

Judgment on the arbitration award may be entered in any court having jurisdiction.

18.3 Attorneys' Fees

Each party shall bear its own costs and attorneys' fees in connection with any arbitration or legal proceeding, except where applicable law or the arbitrator authorizes an award of reasonable attorneys' fees and costs.

18.4 Class Action Waiver

YOU AND PRIMEPULSE ONLINE INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and PrimePulse Online Inc agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding, to the extent permitted by applicable law.

18.5 Judicial Forum

To the extent any claim is permitted to proceed in court, other than in small claims court where applicable, you and PrimePulse Online Inc agree that the exclusive jurisdiction and venue shall be the state or federal courts located in Los Angeles County, California, except where applicable law requires otherwise.

Shipping Charges

Customers will only be charged once for shipping costs where applicable, including where a return shipment is required under our applicable Refund & Return Policy.

No restocking fee will be charged to consumers for the return of a product where such fee is prohibited by our applicable policies or applicable law.
